Terms and Conditions
These terms and conditions apply to the use of this website at www.penlonbrewery.co.uk. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.
We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.
2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if you do not provide sufficient identification required when ordering certain items;
(d) if there has been a pricing or product description error; or
(e) if you do not meet any eligibility criteria set out in our terms and conditions.
3.1 In accordance with the Licensing Act 2003, it is an offence for any person under 18 to buy or attempt to buy intoxicating drinks. We will only sell to anyone who is 18 years of age or over, as the law requires. By placing an order you confirm that you are at least 18 years old.
3.2 If you are buying a case of products as a gift – the recipient must also be over 18 years old.
3.4 If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the products is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the products.
3.5 Once the products have been delivered, according to your original delivery instructions, it becomes the recipient’s responsibility.
3.1 Transactions are in British Pounds and inclusive of VAT. Delivery charges if applicable are added at the checkout.
3.2 Where we charge separately for packing and carriage, the appropriate rates are made clear on this Website.
4.1 We will email you with the method of delivery.
4.2 Please ensure there will be someone available to sign for the package when it arrives.
4.3 Standard UK delivery is 3-5 working days.
4.4 All orders received by us are shipped subject to availability.
4.5 We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of delivery of the product.
Cancellation and Returns Policy
5.1 If you wish to cancel your order:
(a) you can notify us by email to email@example.com before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 5.2 below.
5.2 You can return goods you have ordered from us at any time within 14 days of receipt. The costs of returning goods to us shall be borne by you.
It is important to us that you receive your order in pristine condition and we assure you we will make every effort to ensure this is the case. However, bottles may unfortunately get damaged in transit. Inspect your delivery for breakages and leakages, if it is apparent it has occurred, refuse the delivery and ask the courier to return it to us. We will replace your purchase as soon as possible at no extra cost to yourself. Claims for breakages or shortages need to be stated on the courier’s paperwork.
5.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.
5.4 The rights to return the goods to us as referred to in clause 5.3 will not apply in the following circumstances – in the event that the product has been used; where the packaging has been unsealed; and to any products that we have made or customised specifically for you
The provisions of this clause 5.4 do not affect your statutory rights.
